Welcome to Nulithic Labs! These Terms and Conditions ("Terms") govern your access to and use of our website at nulithic.in, and any mobile games, applications, and related services we provide (including but not limited to Empires of Hindustan) (collectively, the "Services").

By downloading, installing, accessing, or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Services.

1. Acceptance of Terms

By creating an account, making a purchase, or playing our Games, you confirm that you are at least 13 years old (or meet the minimum age of digital consent in your country) and have the legal capacity to enter into a binding agreement. If you are accessing the Services on behalf of a minor, you represent that you are their parent or legal guardian.

2. Changes to Terms

We reserve the right to modify, alter, or update these Terms at any time. When we make changes, we will update the "Last Updated" date at the top of this document. Your continued use of the Services after any changes constitutes your acceptance of the new Terms. We encourage you to review this page periodically.

3. User Accounts and Security

  • Account Creation: To access features like cloud saves, cross-device sync, and leaderboards, you may need to sign in using Google Play Games Services, Firebase Authentication, or other supported platforms.
  • Account Responsibility: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
  • Termination: We reserve the right to suspend or terminate your account and access to the Services immediately, without prior notice, if you violate these Terms or engage in fraudulent, abusive, or illegal behavior.

4. In-App Purchases, Virtual Goods, and Payments

  • Virtual Currency and Items: The Services may allow you to purchase virtual currency, items, resources, or special passes (collectively, "Virtual Items") using real-world currency.
  • License, Not Ownership: You do not own Virtual Items; rather, you acquire a limited, personal, non-exclusive, non-transferable, revocable license to use them strictly within the Services. Virtual Items have no real-world cash value and cannot be redeemed for cash.
  • Billing and Processing: All financial transactions for in-app purchases are handled securely through third-party billing platforms (such as Google Play Billing and regional processors like BillDesk). We do not store your credit card or sensitive financial information on our servers.
  • Refund Policy: All purchases are final and non-refundable, except as required by applicable law or the refund policies of the applicable store platform (e.g., Google Play).

5. User Conduct and Prohibited Activities

You agree not to misuse the Services. You will not:

  • Cheat or Exploit: Use unauthorized third-party programs, bots, hacks, or exploits to manipulate gameplay, resources, leaderboards, or in-app purchases.
  • Reverse Engineer: Decompile, reverse engineer, disassemble, or attempt to derive the source code of our Games or underlying systems.
  • Harass Others: Use chat systems (if applicable), player profiles, or leaderboards to harass, threaten, or abuse other players or Nulithic Labs staff.
  • Impersonate: Misrepresent your identity or affiliation with Nulithic Labs or any other individual or entity.
  • Commercial Exploitation: Sell, rent, lease, or trade your game account or Virtual Items to any third party.

6. Intellectual Property Rights

All content included in the Services—including text, graphics, user interfaces, artwork, computer code, audio, music, software, and trademarks (including Empires of Hindustan and Nulithic Labs)—is the property of Nulithic Labs or its licensors and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited license to download and play our Games for your personal, non-commercial entertainment only.

7. Privacy Policy

Your use of the Services is also governed by our Privacy Policy, which outlines how we collect, use, and protect your data (including data processed via the Google Play Games Services Recall API and Firebase). Please review our Privacy Policies to understand our data practices.

8. Updates, Patches, and Service Availability

  • Modifications: We reserve the right to modify, update, suspend, or discontinue the Services (or any part thereof) at any time with or without notice.
  • Compatibility: We do not guarantee that our Games will be compatible with all devices, operating systems, or network configurations.

9. Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. To the fullest extent permitted by law, Nulithic Labs disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, or error-free, or that save data will never be lost.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Nulithic Labs, its directors, employees, or partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, or goodwill, arising out of or in connection with your use of or inability to use the Services.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any legal action or proceeding arising out of these Terms shall be brought exclusively in the courts located in Bijnor, Uttar Pradesh, and the High Court of Judicature at Allahabad.
